1.  GENERAL TERMS AND CONDITIONS Adem en Extase

 

 

2.  CONCEPTS

 

2.1.  Adem en Extase is located at Lekpoort 14, 2152 HS, Nieuw-Vennep and is registered with the Chamber of Commerce under number: KVK 34128268 and Branch no. 000003267644.

 

2.2.  General Terms and Conditions: these general terms and conditions used by Adem and Extase, which are published on the website: www.ademenextase.nl  

 

2.3.1  Participant: the person who follows or wishes to follow a Workshop or Retreat at Adem en Extase.

 

2.3.2 Client: the person who follows or wishes to follow a private session at Adem en Extase.

 

2.4.  Website: website of Adem and Extase: www.ademenextase.nl

 

2.5.  Workshop or Retreat: an event organized by Adem en Extase, such as a Breath lesson, Yoga lesson, a Qigong lesson, a Sound (healing) Journey, a sound concert, an (active) meditation or other activity, or a combination of these.

 

2.6.  Workshop Giver: The person who gives the Workshop. This can be a Adem en Extase employee or an external one.

 

 

3.  APPLICABILITY

 

3.1.  The General Terms and Conditions apply to private sessions, and to participation in any Workshop or Retreat, given by or at Adem en Extase, or advice in the broadest sense of the word. By participating in a private session, Workshop or Retreat, the client or Participant agrees to the applicability of these General Terms and Conditions.

 

3.2.  Adem en Extase may change these Terms and Conditions from time to time. The latest version of the General Terms and Conditions is always the current version and is always available on the Website.  

 

3.3.  Deviations from these General Terms and Conditions are only binding if they have been confirmed in writing by both the client or participant and Adem en Extase.

 

 

4.  REGISTRATION AND PAYMENT

 

4.1.  A Client or Participant can register for a Workshop or Retreat by email, via the email address : Ademenextase@gmail.com. Or via the website of the location where the event takes place.

 

4.2.1  A Workshop or Retreat of Adem en Extase must be paid prior to the Workshop or Retreat to be followed, within the term indicated by Adem en Extase. Payment can be made by bank transfer to the bank account indicated by Adem en Extase, or in cash if this has been agreed in advance by the Participant with Adem en Extase. It is also possible that payment must be made to a bank account of the location (for example Yoga Studio) where the event takes place.

 

4.2.2 A Client receives an invoice after the private session and therefore pays afterwards.

 

4.3.  A Participant is guaranteed a place if he/she has paid within the specified payment term and after payment has been received by Adem en Extase or by the location where the event takes place.

 

4.4.  Adem en Extase reserves the right to refuse participation of the Participant in the Workshop or Retreat in the event of non-payment.

 

4.5.  Before the start of the Workshop or Retreat, the Participant must report to an employee of Adem en Extase (or the location) who will check the registration and payment for the relevant Workshop.

 

4.6.  Adem en Extase reserves the right to change prices. Any changes will be announced in advance by means of a mention on the Website and/or by e-mail. The current applicable prices are always stated on the Website.

 

4.7. Prices include VAT, unless stated otherwise.

 

4.8. The VAT percentage used is 21%.

 

 

5.  CANCELLATION PARTICIPATION WORKSHOP OR RETREAT

 

5.1.  The Participant can cancel free of charge up to 6 weeks before the planned Workshop or Retreat. This can be done by email to Ademenextase@gmail.com. The Participant in a workshop will then receive a refund of the amount paid for the Workshop. In case of a retreat, the participant will receive the amount paid for the retreat, minus 35,- Euro administration costs.

 

5.2.  If the Participant cancels her/his registration less than 4 weeks before the planned Workshop or Retreat, then she/he will receive a refund of 50% of the Workshop price, or 50% of the Retreat price.

 

5.3.  If the Participant cancels her/his registration within 48 hours before the planned Workshop or Retreat, the Workshop price or the Retreat price paid will not be refunded. The Participant has the right to transfer the reservation for the Workshop to someone else; this can be done by emailing the details of this person to Adem and Extase via Ademenextase@gmail.com.

 

5.4.  Adem en Extase reserves the right to cancel the planned Workshop or Retreat without giving any reason.

 

5.5.  Adem en Extase reserves the right to change the location of the planned Workshop or Retreat without giving any reason.

 

5.6.  If the Workshop or Retreat is canceled by Adem en Extase, the Participant will receive the Workshop price paid back. In case of a retreat, the participant will receive a refund of the paid Retreat price, excluding the administration costs amounting to EUR 35. Or, in consultation, a new date of participation will be agreed.

 

 

6.  AGENDA

 

6.1.  The current Workshop agenda can be found on the Website. Adem en Extase is not liable for any inaccuracies in the agenda on the Website, in the newsletter or in other communication.

 

6.2.  Adem en Extase reserves the right to cancel or change a planned Workshop or Retreat. Any changes will be announced in advance as far as possible by email or via the newsletter.

 

 

7.  HOUSE RULES

 

7.1.  All Participants must observe the house rules of Adem and Extase:

• Participants must park their car, bicycle or other means of transport in such a way that other visitors do not suffer or suffer damage.

• Do not cause noise nuisance for local residents and fellow visitors upon arrival and departure of an event.

• Come to the event or workshop/session room hygienically. Wear clean clothes that allow you to breathe, move and/or lie comfortably.

• Shoes are taken off at the entrance. Shoes are not desired in the session room.

• Adem en Extase provides yoga mats and/or cushions for use during the session/Workshop. The yoga mat must always be cleaned and cleaned up after use by the Participant who has used it.

• Participants are requested to speak quietly or not before, during and after the session/Workshop and to follow the instructions of Adem and Extase employees and any external Workshop providers.

7.2.  Adem en Extase reserves the right to deny access to Participants who, in its opinion, do not comply with the house rules, as referred to in this article, after a warning, and to terminate participation in a Workshop, session or Retreat of the relevant Participant without refund of the entrance fee paid.

 

 

8.  USE MATERIALS (workbook, videos and emails)

 

8.1.  Copyright applies to materials developed by Adem en Extase (texts, handouts, instructions, workbooks, videos). The participant may use these materials during and after the workshop. It is not permitted to share these with third parties, unless Adem en Extase has given explicit written permission for this.

 

8.2.  It is also not allowed to sell the acquired knowledge commercially or to include it in your own program, unless Adem en Extase has given explicit written permission for this.

 

 

9.  LIABILITY

 

9.1.  Following private sessions, Workshops, Retreats, parking cars, bicycles and other means of transport and leaving things behind at Adem en Extase is at the Participant's own risk. Adem en Ecstasy does not accept any liability for physical and/or mental injury, loss or damage related thereto.

 

9.2.  Adem en Extase provides high quality sessions, workshops and retreats. However, there is always the risk of physical and/or mental injury during a Session/Workshop/Retreat. By participating in an event at Adem en Extase, the Participant accepts this risk of physical and/or mental injury. Adem en Extase provides the following guidelines to reduce the risk of injury:

• Consult a doctor or therapist before starting a Workshop/session/retreat if you are not sure that you are completely healthy, or if you are pregnant.

• If you are pregnant, have an injury, or any other physical or mental discomfort, always report this to the relevant Workshop giver before the Workshop starts.

• Listen carefully to your body's signals and act on them carefully.

• Listen carefully to the instructions of the relevant Workshop giver and follow them.

• Perform exercises carefully and listen to your physical limitations.

• Do not perform exercises that are painful for you.

• Inquire with the Workshop-giver if you do not understand an exercise.

 

10.     PERSONAL DATA

 

10.1.      Adem en Extase collects personal data from the Participants for the execution of payment orders, for administration and for information purposes. Adem en Extase handles this collection of personal data with care, taking into account the provisions of the Personal Data Protection Act and the Telecommunications Act.

 

10.2.      Adem en Extase uses the personal data referred to in Article 9.1, among other things, to inform the Participants of the activities of Adem en Extase, any changes to the agenda and any changes to the general terms and conditions. If the Participant does not wish to receive communication from Adem en Extase, this can be communicated by e-mail to: Ademenextase@gmail.com or by unsubscribing from the newsletter via a link at the bottom of the newsletter.

 

10.3.      Adem en Extase will never provide the personal data of the Participants to third parties without the Participant's prior written consent.

 

 

11.     COMPLAINTS PROCEDURE

 

11.1.      Complaints regarding the services and products of Adem and Extase can be sent in writing to:

11.2.      Adem en Extase confirms receipt, and thus the handling, of the complaint in writing to the submitter.

 

11.3.      Complaints will be answered substantively within 10 working days after confirmation of receipt.

 

11.4.      The Participant must give Adem en Extase at least 4 weeks, from the moment of the confirmation of receipt, to resolve the complaint in mutual consultation. After this term, a dispute arises that is subject to the dispute settlement procedure.

 

 

12.     APPLICABLE LAW AND DISPUTE RESOLUTION

 

12.1.      The General Terms and Conditions are exclusively governed by Dutch law.

 

12.2.      The language used by Adem and Extase is Dutch.

12.3.      In the event of any disputes, the Participant and Adem en Extase will always do their best to resolve the dispute among themselves before a dispute is submitted to a mediator or judge.

 

12.4.      If the Participant and Adem en Extase cannot reach an agreement, any disputes related to the General Terms and Conditions, attending Workshops or purchasing other products and services from or from Adem en Extase will in the first instance be settled by a recognized mediator. If it is not possible to reach a satisfactory solution for both parties with a recognized mediator, the dispute will be settled at the competent court.
